What is Family Mediation?

Family mediation is a process where parties meet with a mediator who aids discussions with the aim of reaching an agreed way forward for their particular circumstances. It is usually much less costly than taking matters to court. It also leaves decision-making power with the family rather than handing it to a judge, who would be required by law to make a decision.

It is usual for a Family mediator to help both parties find solutions that will work best for their individual situation, taking into account the needs of all children involved. It is possible for the process to become emotional, but it is important that both parties remain focused and do not let their emotions take over. The confidentiality of a mediation session means that discussions during the sessions are not admissible in court and that anything said there cannot be used against either party. The exception is in cases of alleged threats or violence, when this information must be reported.
